Terms and Conditions

Effective Date: 16 December 2025

1. Definitions

  • Company refers to Sunshine Charter and Tours.
  • Customer refers to the individual or group booking services with the Company.
  • Passenger(s) refers to all persons travelling under the Customer’s booking.
  • Booking refers to the reservation made with the Company for transport services.
  • Bond refers to the security deposit paid by the Customer to cover potential damages, cleaning, or breaches of policy.
  • Service refers to any charter, tour, or transport provided by the Company.

2. Booking Confirmation

  • A booking is confirmed once full payment is received prior to the confirmed booking date.
  • Once issued, the Booking Confirmation is the official record of your reservation.
  • Customers must review the Booking Confirmation carefully and notify Sunshine Charter and Tours immediately of any errors.
  • Times listed are departure times from the nominated location, not vehicle arrival times. Customers should allow sufficient time for boarding and possible delays including traffic, diversions, or weather.
  • Journey durations and routes are indicative only. The Company does not guarantee arrival times at destinations, events, or performances.

3. Amendments

  • Requests to alter a booking must be submitted in writing.
  • A change is only valid once Sunshine Charter and Tours has acknowledged it and issued a revised Booking Confirmation.
  • If no updated confirmation is received, the original booking remains binding.
  • Drivers are not authorised to accept or confirm amendments. Verbal changes are not recognised.
  • Additional charges may apply depending on the nature of the amendment.

4. Cancellation Policy

  • Cancellations are only valid if submitted in writing via email.
  • Deposits (typically 25% of the total booking value) are non-refundable in all circumstances.
  • If full payment has been made, refunds (calculated from 75% of the total booking value) apply as follows:
    • More than 21 days’ notice: 75% refund
    • 15–20 days’ notice: 50% refund
    • 14 days or fewer: No refund
  • No-shows will result in forfeiture of the full booking amount.
  • The Company may issue a credit in lieu of a refund at its discretion.
  • If the Company cancels due to mechanical failure, driver illness, or unsafe conditions, a full refund or rescheduled service will be offered.
  • Approved refunds will be processed within 7 business days via the original payment method.

5. Liability

  • The Company is not liable for delays caused by traffic, weather, or external factors beyond its control.
  • Customers are responsible for selecting appropriate collection times.
  • No responsibility is accepted for missed events or associated costs due to late arrival.

6. Customer Responsibilities

Timeliness

  • Passengers must be ready at the agreed pickup time.
  • A maximum 15-minute waiting period applies. Additional charges may apply or the booking may be deemed a no-show.
  • Drivers may terminate the booking after reasonable contact attempts.

Communication

  • Customers must promptly notify the Company of any pickup changes.
  • Failure to communicate may result in delays or additional costs.

Alcohol

  • Alcohol consumption must be responsible.
  • Excessive mess, spills, or damage will result in bond forfeiture and possible additional charges.

Respect

  • Vehicles and staff must be treated with care and respect.
  • Inappropriate behaviour or damage may result in extra charges and refusal of future service.

Luggage and Passenger Numbers

  • Vehicles are allocated based on passenger numbers and luggage details provided at booking.
  • Customers must supply accurate information and advise of any changes.

7. Payments

  • All fees must be paid in full before travel unless otherwise agreed in writing.
  • Outstanding balances may be charged to the original payment method. Chargebacks are not permitted.
  • Deposits and balances are due by the agreed date (normally 14 days prior to travel).
  • Failure to pay may result in cancellation, forfeiture of payments, and immediate liability for the full balance.
  • Prices are not guaranteed if payment is not received within the agreed timeframe.

8. Acceptance and Governing Law

By making a booking, the Hirer confirms they have read, understood, and agree to these Terms and Conditions.
These Terms and Conditions are governed by the laws of Queensland, Australia, and subject to the exclusive
jurisdiction of the courts of Queensland.
